DMCA Policy

Austinlifestylemagazine Store respects intellectual property rights and expects all users to do the same. This DMCA Policy explains how we respond to copyright infringement claims under the U.S. Digital Millennium Copyright Act (“DMCA”).

1) Reporting Copyright Infringement (DMCA Notice)

If you believe that content available on our website infringes your copyright, you may submit a written DMCA notice including all of the following:

  1. Your signature (physical or electronic) as the copyright owner or authorized agent

  2. Identification of the copyrighted work you claim has been infringed (or a representative list if multiple works)

  6. A statement that the information in your notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on their behalf

2) What Happens After We Receive a Valid Notice

Upon receipt of a complete and valid DMCA notice, we may:

  • Remove or disable access to the allegedly infringing material

  • Notify the affected party (if applicable)

  • Take reasonable steps to address repeated infringement when appropriate

3) Counter-Notification (If You Believe Content Was Removed by Mistake)

If you believe content was removed or disabled due to mistake or misidentification, you may submit a DMCA counter-notification including:

  1. Your physical or electronic signature

  2. Identification of the material that was removed or disabled and the location where it appeared before removal

  3. A statement under penalty of perjury that you have a good-faith belief the material was removed due to mistake or misidentification

  4. Your name, address, phone number, and email address

  5. A statement that you consent to the jurisdiction of the federal court in your district (or, if outside the U.S., to a U.S. federal court jurisdiction), and that you will accept service of process from the person who submitted the original DMCA notice or their agent

If a valid counter-notice is received, we may forward it to the original complainant. If the complainant does not file a court action within the timeframe required by the DMCA, we may restore the material at our discretion.

4) Repeat Infringers

In appropriate circumstances and at our discretion, Austinlifestylemagazine Store may terminate or restrict access for users or accounts that are determined to be repeat infringers.

5) Misrepresentations

Under the DMCA, anyone who knowingly materially misrepresents that material is infringing (or was removed by mistake) may be subject to liability. Please submit claims only when you have a legitimate basis.
